High Court Lifts Stay over Completion of YAI Council Elections

The division bench of the Delhi High Court today lifted the stay over opening of ballots, counting of votes and declaration of result for YAI Council elections. The stay was granted on 15 Jul 2013 by a single Bench. A division Bench headed by the Acting Chief Justice BADAR DURREZ AHMED and Justice VIBHU BAKHRU today lifted the stay over opening of ballots, counting of votes and declaration of results.

 

The stay was lifted on an appeal filed by the YAI. On behalf of the YAI, Advocate Sandeep Sethi, averred that as per law, once the election process has been set into motion, a stay is not maintainable. Advocate Sethi had also argued that the only remedy available with an individual to challenge an election is by way of an election petition. Sethi also said that since no election petition had been filed, the petition filed by Boardsailing Association and 11 others, all members of the YAI, was not maintainable.
